FireCompliance.ca (the “Platform” or “Service”) is operated by Digital Automations AI (“Company,” “we,” “us,” or “our”). This Disclaimer outlines the limitations of our liability and your responsibilities when using our fire safety compliance management platform.
1. Platform Services Description
FireCompliance.ca provides a fire safety compliance management platform that facilitates:
- Property registration for commercial and multi-family residential buildings
- Fire safety self-assessment submissions by property owners and managers
- Inspection scheduling and tracking
- Document management and record-keeping
- Automated reminder services (phone, SMS, email)
- Reporting tools for municipal fire departments
- AI-powered customer service and support
- Risk-based compliance monitoring
2. IMPORTANT DISCLAIMER
IT DOES NOT REPLACE PROFESSIONAL FIRE SAFETY INSPECTIONS, ENGINEERING ASSESSMENTS, OR EXPERT ADVICE FROM QUALIFIED FIRE SAFETY PROFESSIONALS.
2.1 Self-Assessment Limitations
The Fire Safety Self-Assessment feature allows property owners to report on the condition of fire safety systems in their buildings. Digital Automations AI and FireCompliance.ca expressly disclaim any responsibility for:
- The accuracy, completeness, or truthfulness of information provided by property owners or their representatives
- Misrepresentations, whether intentional or unintentional, made by property owners
- Omissions or errors in self-assessment responses
- The actual condition of fire safety equipment, systems, or building features
- Any reliance by third parties on self-assessment data
- Decisions made by fire authorities based on self-assessment submissions
2.2 No Guarantee of Compliance
Use of this Platform does NOT guarantee:
- Compliance with the BC Fire Safety Act or any fire code
- That a property meets fire safety standards
- That fire safety equipment is functional or properly maintained
- That a building is safe from fire hazards
- Approval from the Office of the Fire Commissioner or any authority having jurisdiction (AHJ)
- Reduced insurance premiums or favorable insurance terms
- Protection from fire-related losses or damages
2.3 No Professional Advice
Nothing on this Platform constitutes:
- Professional fire safety engineering advice
- Legal advice regarding fire code compliance
- Building code interpretation
- Insurance advice or recommendations
- A professional inspection report
- A certification of fire safety compliance
- Medical or emergency response advice
2.4 AI-Powered Services
FireCompliance.ca uses AI-powered services for customer support, reminders, and data processing. AI systems:
- May provide general information but not professional advice
- May occasionally provide inaccurate or incomplete information
- Should not be relied upon for life-safety decisions
- Do not replace consultation with qualified professionals
3. LIMITATION OF LIABILITY
3.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL AUTOMATIONS AI, FIRECOMPLIANCE.CA, AND THEIR OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
a) Any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Use or inability to use the Platform
- Reliance on information provided through the Platform
- Self-assessment data submitted by property owners
- Actions or inactions of property owners
- Fire damage, personal injury, or property damage
- Loss of life or bodily injury
- Loss of business, revenue, or profits
- Regulatory penalties or enforcement actions
- Insurance claim denials or coverage disputes
- Criminal charges or civil litigation
b) Any claims arising from:
- Inaccurate, incomplete, or false information submitted by users
- Property owner misrepresentation
- System outages, errors, or technical failures
- Data loss or corruption
- Unauthorized access to user accounts
- Third-party services or integrations
- Communication delivery failures (phone, SMS, email)
- AI-generated content or responses
3.2 Maximum Liability Cap
IN NO EVENT SHALL THE TOTAL LIABILITY OF DIGITAL AUTOMATIONS AI AND FIRECOMPLIANCE.CA EXCEED THE GREATER OF:
- THE AMOUNT PAID BY YOU TO US FOR PLATFORM SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR
- ONE HUNDRED CANADIAN DOLLARS ($100 CAD)
3.3 Essential Purpose
THE LIMITATIONS IN THIS SECTION SHALL APPLY:
- Even if any remedy fails of its essential purpose
- Regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise)
- Even if we have been advised of the possibility of such damages
- To the fullest extent permitted by applicable law
4. INDEMNIFICATION
4.1 By Property Owners
Property owners and their representatives agree to indemnify, defend, and hold harmless Digital Automations AI, FireCompliance.ca, and their officers, directors, employees, contractors, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- False, inaccurate, or misleading information submitted to the Platform
- Failure to disclose known fire safety deficiencies
- Failure to maintain fire safety equipment
- Failure to comply with fire safety regulations
- Any violation of these Terms or the Terms of Service
- Any injury, death, or property damage at their property
- Claims by tenants, visitors, or other third parties
- Insurance claims or disputes related to fire safety
4.2 By Municipalities
Municipal clients agree to indemnify Digital Automations AI and FireCompliance.ca from claims arising from:
- Enforcement decisions based on Platform data
- Inspection scheduling or prioritization decisions
- Reliance on self-assessment information
- Data handling within their jurisdiction
- Regulatory actions taken or not taken
- FOIPPA compliance within their organization
5. PROPERTY OWNER ACKNOWLEDGMENTS
By using this Platform, property owners acknowledge and agree that:
- SELF-ASSESSMENT RESPONSIBILITY: I am solely responsible for the accuracy of all information I provide, including self-assessment responses. Neither Digital Automations AI nor FireCompliance.ca verifies the information I submit.
- NO SUBSTITUTE FOR INSPECTION: Self-assessments do not replace required fire safety inspections by qualified inspectors. I understand that professional inspections are still required by law.
- ONGOING OBLIGATIONS: I remain responsible for maintaining fire safety equipment and compliance regardless of self-assessment submissions. The Platform does not assume any of my legal obligations.
- TRUTHFUL REPORTING: I will provide truthful, complete, and accurate information. Providing false information may result in regulatory penalties, civil liability, and criminal charges.
- NO PLATFORM LIABILITY: Digital Automations AI and FireCompliance.ca are not responsible for fire safety conditions at my property, regardless of what information I submit through the Platform.
- PROFESSIONAL CONSULTATION: I will consult qualified fire safety professionals for advice regarding fire protection systems, equipment, and compliance requirements. The Platform is not a substitute for professional advice.
- INSURANCE: I maintain appropriate insurance coverage for my property and will not rely on Platform use as evidence of insurability or compliance.
- INDEPENDENT VERIFICATION: Municipal fire departments may independently verify information I provide and may conduct physical inspections regardless of my self-assessment submissions.
- RISK ACCEPTANCE: I understand and accept the inherent risks of relying on self-reported compliance information.
- NO WARRANTY: The Platform is provided “as is” without warranties of any kind, express or implied.
6. MUNICIPAL CLIENT ACKNOWLEDGMENTS
Municipalities using this Platform acknowledge that:
- INDEPENDENT VERIFICATION: Self-assessment data requires independent verification through physical inspections. The Platform is a screening and management tool, not a substitute for inspection programs.
- RISK-BASED APPROACH: The Platform’s risk scoring is a screening tool based on user-submitted data, not a definitive assessment of fire safety compliance or actual risk.
- PROFESSIONAL JUDGMENT: Final compliance determinations require professional judgment by qualified fire officials. Platform data should inform, not replace, professional decision-making.
- DATA LIMITATIONS: Platform data may be incomplete, outdated, or inaccurate due to property owner submissions. Data should be treated as preliminary information.
- NO GUARANTEE: Platform use does not guarantee detection of all fire safety violations or hazards. The municipality remains responsible for its fire safety inspection programs.
- LIABILITY: The municipality, not Digital Automations AI or FireCompliance.ca, bears responsibility for enforcement decisions and regulatory actions.
7. DATA AND ACCURACY
7.1 Data Accuracy
Digital Automations AI and FireCompliance.ca do not verify the accuracy of information submitted by users. We are not responsible for errors, omissions, or misrepresentations in user-submitted data.
7.2 Data Retention
We retain data in accordance with our Privacy Policy and applicable regulations, including FOIPPA requirements for municipal data.
7.3 No Warranty
We make no warranties regarding the accuracy, reliability, completeness, or timeliness of any data stored in or generated by the Platform.
8. SERVICE AVAILABILITY
8.1 No Guarantee of Availability
We do not guarantee uninterrupted access to the Platform. Service may be suspended for maintenance, updates, security issues, or unforeseen circumstances.
8.2 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.
8.3 No Liability for Downtime
We are not liable for any damages, missed deadlines, or compliance issues resulting from Platform unavailability.
9. VOICE AND COMMUNICATION SERVICES
Our automated communication services (phone calls, SMS, and email) are provided for convenience only:
- Reminder delivery is not guaranteed
- Technical issues may prevent message delivery
- Users remain responsible for meeting their compliance obligations regardless of reminder receipt
- Phone calls may be recorded for quality assurance and record-keeping
- AI-powered voice services may occasionally misinterpret or provide inaccurate information
- Communication services may be subject to third-party terms and limitations
10. EMERGENCY SITUATIONS
FireCompliance.ca is NOT an emergency service. The Platform cannot summon emergency responders. Do not use the Platform to report active fires, medical emergencies, or other urgent situations.
11. GOVERNING LAW
This Disclaimer and all related matters shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia or through arbitration as specified in our Terms of Service.
12. SEVERABILITY
If any provision of this Disclaimer is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
13. ENTIRE AGREEMENT
This Disclaimer, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Digital Automations AI regarding the FireCompliance.ca Platform.
